Buying a home in Houston from outside the United States

What actually comes up — the legal side, the financing side, who needs to be on the team — from deals closed in Spanish with buyers who had never lived here.

The fear is almost never the money. It is not knowing what you are legally walking into.

I have closed these. One of my clients wrote his review about exactly this, and it says the thing better than I can:

“Wanting to buy property in Texas filled us with uncertainty about the legal process it would involve as a citizen of another country. Meeting Oscar gave us the confidence and the legal certainty to go ahead.”
— Francisco, buying from outside the U.S.

So here is what actually comes up, in the order it comes up.

You can buy. That part is simpler than people expect

There is no citizenship or residency requirement to own residential property in Texas. The complications are not about permission. They are about identification, financing, how money gets here, and taxes — and each of those has a specific person whose job it is to answer it.

Identification and how you will hold title

You will need to be identifiable to a lender, a title company and the IRS, which for a lot of buyers means a taxpayer identification number. Some buyers hold title personally; some are advised to use an entity. That choice has tax and liability consequences that are not mine to decide for you, and it is much easier to set up before the contract than to unwind after closing. We raise it in week one, not at the closing table.

Financing, or not

Cash is the simplest path and plenty of cross-border purchases are cash. If you want a loan, there are lenders who write what the industry calls foreign national programs. The terms are different from a standard domestic loan, they vary a lot between lenders, and they change. The useful thing is not a number I quote you today — it is getting two or three real quotes on your own file and reading them side by side. I will sit in that call with you.

“And something very important — choosing the best option for the financing.”
— Francisco

Getting the funds here on time

This is the part that surprises people and the part that breaks closing dates. International transfers take longer than domestic ones, the documentation on the source of funds is real, and title companies have their own requirements. We work backwards from the closing date and start the money conversation early, because a wire that arrives two days late does not care how good the rest of the deal was.

Tax, including the part on the way out

Ask a CPA before you buy, not after. In particular, there are federal withholding rules that apply when a foreign owner sells U.S. real estate, and they affect how much of your own money you walk away with at that future closing. Knowing that going in sometimes changes how a buyer structures the purchase. I am not a CPA and I will not guess at your situation — but I will make sure the question gets asked while it is still cheap to answer.

Where my job ends. I am a real estate agent. I am not an attorney, a CPA, or an immigration advisor, and nothing here is legal or tax advice. What I do is run the purchase, tell you plainly which questions belong to someone else, and help you get those people on the team early.

How showings work when you are not here

Video walk-throughs on my phone, with me pointing the camera at the things you would want to see rather than the things that photograph well. Then, when you fly in, a tight schedule of the handful of homes that survived the video — not fourteen showings in two days.

“He walked us through the showings without rushing, and with real knowledge of construction and the market, led us to the best option.”
— Francisco

Flood history, which you cannot see from another country

Houston specifically: I check the flood history on the property, the current maps, and the elevation and drainage on that street. From abroad there is no way for you to know this, and it is not in the listing.

All of it in Spanish if you want it

Showings, the contract, the financing conversation, the closing. Whichever language you would rather be making a decision this size in — that is the language we use.

Financiamiento, o no
